TERMS OF USE

 1. Contractual Relationship

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Laiharee Group Pte Ltd (Singapore) and Laiharee Lda (Timor-Leste) (collectively, “Laiharee,” “we,” or “us”). By accessing the platform or using the services, you agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Platform.


2. Service Description & Structure

  • The Platform: Laiharee provides the Lalais Platform, a digital intermediate service that connects Passengers with available Drivers for on-demand transport and facilitates payments.
  • Passenger Transport Only: We are strictly a passenger ride-share platform. We do not provide physical delivery, courier, or logistics services.
  • Corporate Structure:
    • Technology Provider: Laiharee Group Pte Ltd (Singapore) owns and operates the digital platform/app ("Platform").
    • Operational Provider: Laiharee Lda (Timor-Leste) manages local user engagement and facilitates transport operations.
  • Independent Contractors: Transport services are provided by independent contractors. These drivers are not employees, agents, or representatives of Laiharee. Laiharee does not provide transportation services directly.


3. User Accounts & Privacy

  • Registration: You must provide accurate, current, and complete information. You are responsible for all activity under your account.
  • Data Controller: You acknowledge that data processing is managed by the Singapore entity as the primary data controller for the purpose of maintaining the Platform’s security and functionality.
  • Accountability: You must maintain account security and provide a valid phone number and email to receive transaction receipts.


4. Pricing, Payments & Taxes

  • Transparent Pricing: Fares are calculated based on a base rate plus distance and time. An "Estimated Fare" is provided via the Platform before you confirm your booking. Fares may fluctuate based on local demand or peak hours.
  • Payment Authority: You authorize Laiharee to charge your designated payment method (credit card or mobile wallet) via our third-party processors. You warrant that you are the authorized user of the payment account.
  • Taxes and Levies: Displayed prices include applicable local taxes and government transport levies in Timor-Leste.
  • Currency: All transactions are processed in USD (or the local legal tender of Timor-Leste).


5. Service Fulfilment

  • Confirmation: A service is considered "confirmed" once a Driver accepts your request through the Platform.
  • Completion: Fulfilment occurs when the Passenger is picked up and successfully transported to the designated drop-off location.
  • Proof of Service: Upon completion, a digital receipt is automatically generated and sent to your registered email or App history, serving as your record of fulfilment.


6. Cancellations and Refunds

  • User Cancellations: You may cancel a request at any time. However, if a Driver has been dispatched for more than 2 minutes, a non-refundable Cancellation Fee will be charged.
  • Driver Cancellations: If a Driver cancels after accepting or fails to arrive, you will not be charged.
  • Refunds:
    • Incomplete Trips: If a trip is terminated early due to vehicle breakdown or driver fault, you are entitled to a partial or full refund.
    • Overcharges: Claims for technical errors or routing issues must be submitted via "Contact Us" within 48 hours.
    • Processing: Approved refunds will be credited back to the original payment method within 5–10 business days.


7. User Conduct & Safety

  • Lawful Use: You shall not harass drivers, transport illegal/hazardous goods, or interfere with the Platform’s performance.
  • Damage to Vehicle: You are responsible for fees resulting from damage to the vehicle caused by you or your party (e.g., cleaning or repair fees).
  • Fraud Prevention: Attempts to reverse a legitimate charge (chargeback) without contacting support first will result in immediate account blacklisting.
  • Ratings: We use a mutual rating system and reserve the right to suspend accounts with consistently low ratings.


8. Intellectual PropertyAll content, branding, trademarks, and underlying technology remain the exclusive property of Laiharee Group Pte Ltd. Your license to use the app is limited, non-exclusive, and revocable.


9. Disclaimers & Limitation of Liability

  • "As-Is" Basis: We do not guarantee that the Service will be uninterrupted or error-free.
  • Third-Party Conduct: To the extent permitted by law, Laiharee is not responsible for the conduct or omissions of drivers.
  • Liability Cap: Our total liability for any claim shall not exceed the amount paid for the specific ride in question. We are not liable for indirect or consequential losses.


10. IndemnityYou agree to indemnify Laiharee Group Pte Ltd and Laiharee Lda against any claims or expenses (including legal fees) arising from your misuse of the platform, breach of these terms, or violation of the rights of any third party.


11. Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by the laws of Singapore, except for operational transport matters which follow Timor-Leste regulations.
  • Dispute Resolution: Disputes shall first be attempted to be resolved through negotiation. Unresolved disputes shall be settled via binding arbitration in Singapore or Dili, at the company's discretion.
